Welkom bij Pricebeat!

Bij Pricebeat geloven we in transparantie, eerlijkheid en respect voor je privacy. We willen je geruststellen: we zijn geen boevenclub. We vinden juist dat het makkelijker moet worden om lagere prijzen online te vinden, want het leven is al duur genoeg. We bespioneren je niet en verkopen je persoonlijke gegevens niet aan derden.

Wat we met je gegevens doen, is precies wat je van ons verwacht. Als je ons vraagt om een product te herkennen, lezen we je scherm om te zien waar je naar kijkt. Lukt dat, dan kijken we of we je een betere prijs kunnen laten zien. Soms verkoopt Pricebeat zelf (dan zie je "Verkocht door Pricebeat.nl"), soms een aangesloten partner (dan zie je "Verkocht door [naam partner]"), en soms sturen we je door naar een andere webshop die goedkoper is. Plaats je een bestelling bij Pricebeat, dan delen we je adresgegevens met de verkopende partij zodat die het product bij je kan bezorgen. Meer dan nodig verzamelen we niet, meer dan nodig delen we niet, en verder doen we geen gekke dingen.

  • Pricebeat / wij / ons: Pricebeat BV.
  • Diensten: de website, mobiele app en Chrome-extensie van Pricebeat, samen met alle functionaliteit daarvan.
  • Gebruiker / je: iedereen die onze Diensten gebruikt.
  • Pricebeat-aanbieding: een aanbieding die je alleen via Pricebeat kunt afrekenen. De verkopende partij wordt altijd duidelijk vermeld vóór het afrekenen en kan Pricebeat zelf zijn ("Verkocht door Pricebeat.nl") of een aangesloten externe partij ("Verkocht door [naam partner]").
  • Verkopende partij: de partij die bij een Pricebeat-aanbieding als verkoper is vermeld en de contractuele wederpartij van de koop is. Alle consumentenrechten (herroeping, garantie, non-conformiteit) lopen tegen deze partij.
  • Externe aanbieding: een prijs die bij ons bekend is en die wij op Pricebeat tonen, met een link naar de webshop waar dat aanbod staat. De volledige aankoop vindt plaats op die webshop; Pricebeat is geen partij bij die transactie. De link kan een gewone link zijn of een affiliate-link; dat verandert niets aan jouw prijs of aan onze rol.
  • Koper: een gebruiker die via een Pricebeat-aanbieding een product koopt.

3. Deze Voorwaarden

Deze Algemene Voorwaarden gelden voor elk gebruik van onze Diensten. Door Pricebeat te gebruiken ga je akkoord met deze Voorwaarden. Gebruik je Pricebeat niet, dan zijn ze niet op jou van toepassing.

4. Je account

Om sommige functies te gebruiken moet je een account aanmaken. Voor je account geldt:

  • Je geeft correcte en actuele gegevens op (naam, e-mail, bezorgadres).
  • Je houdt je inloggegevens geheim en deelt ze niet met anderen.
  • Activiteit vanaf jouw account valt onder jouw verantwoordelijkheid.
  • Merk je dat iemand anders je account gebruikt? Meld het direct op [email protected].
  • Je moet minimaal 16 jaar zijn om een account aan te maken.

5. Hoe Pricebeat werkt

Pricebeat brengt op drie manieren vraag en aanbod bij elkaar. Per manier verandert onze rol en onze verantwoordelijkheid. Welke manier van toepassing is, zie je altijd duidelijk op het productscherm en in de winkelwagen vóór het afrekenen.

5a. Pricebeat-aanbieding, Pricebeat als verkopende partij

Toont de winkelwagen "Verkocht door Pricebeat.nl"? Dan is Pricebeat BV de verkoper. Concreet:

  • De koopovereenkomst komt tot stand tussen jou en Pricebeat.
  • Pricebeat verwerkt de betaling en verzorgt (al dan niet via een ingeschakelde leverancier) de verzending.
  • Pricebeat is verantwoordelijk voor levering, garantie, herroepingsrecht, retouren, non-conformiteit en klantenservice voor deze bestelling.

5b. Pricebeat-aanbieding, externe partij als verkopende partij

Toont de winkelwagen een andere verkoper ("Verkocht door [naam partner]")? Dan is die externe partij de verkoper en treedt Pricebeat op als platform. Concreet:

  • De koopovereenkomst komt tot stand tussen jou en de vermelde externe verkoper, niet met Pricebeat.
  • Pricebeat verwerkt de betaling namens de verkopende partij en geeft je bestelgegevens aan hen door zodat ze kunnen leveren.
  • De externe verkoper is verantwoordelijk voor levering, kwaliteit, garantie, herroepingsrecht, retouren, non-conformiteit en klantenservice.
  • Pricebeat bemiddelt waar mogelijk bij geschillen en kan terugbetalingen verwerken wanneer de verkopende partij daar opdracht toe geeft of daartoe verplicht is.

5c. Externe aanbieding (link naar andere webshop)

Ziet de aanbieding er uit als een knop naar een andere webshop (bijvoorbeeld "Bekijk bij [naam webshop]"), in plaats van een "Toevoegen aan winkelwagen"-knop? Dan is het een externe aanbieding. Je verlaat Pricebeat en koopt rechtstreeks bij die webshop. Concreet:

  • Pricebeat is géén partij bij de transactie. De koopovereenkomst komt uitsluitend tot stand tussen jou en de externe webshop.
  • De algemene voorwaarden van die webshop zijn van toepassing op de aankoop, levering, betaling, garantie, retouren en klantenservice.
  • De prijs, beschikbaarheid en productdetails die wij bij een externe aanbieding tonen, kunnen op het moment dat je doorklikt door de externe webshop al zijn gewijzigd. Wij kunnen niet garanderen dat deze gegevens nog actueel zijn.
  • De link naar de externe webshop kan een gewone link zijn of een affiliate-link waarvoor Pricebeat een vergoeding ontvangt als je een aankoop doet. Dit verandert niets aan de prijs die jij betaalt.
  • Pricebeat heeft geen rol bij levering, betaling, garantie, retouren of klantenservice van een externe webshop. Daarvoor wend je je direct tot die webshop.

Wat jij als koper doet

  • Je geeft correcte betaal- en adresgegevens op.
  • Je leest het retour- en garantiebeleid van de verkopende partij (of, bij een externe aanbieding, van de externe webshop) voordat je bestelt.
  • Je gebruikt het product zoals redelijkerwijs bedoeld.

We proberen alle informatie op het platform zo accuraat mogelijk te houden, maar kunnen niet garanderen dat elk productdetail of elke prijs op elk moment 100% juist is.

6. Retourneren en herroepingsrecht

Als consument heb je recht op ontbinding van de koop binnen 14 dagen na ontvangst, zonder opgaaf van reden. Dit is geregeld in Boek 7, Titel 7AA van het Burgerlijk Wetboek (de Nederlandse uitwerking van de EU-richtlijn consumentenrechten 2011/83/EU). Het herroepingsrecht richt zich altijd tegen de verkopende partij. De procedure hangt daarom af van het type aanbieding.

Pricebeat-aanbieding, Pricebeat als verkoper (§5a)

  • Meld de ontbinding binnen 14 dagen na ontvangst bij Pricebeat via [email protected].
  • Retourneer het product binnen 14 dagen daarna naar het adres dat wij opgeven.
  • Na ontvangst en controle krijg je binnen 14 dagen je geld terug van Pricebeat.

Pricebeat-aanbieding, externe partij als verkoper (§5b)

  • Meld de ontbinding bij de verkopende partij volgens haar retourbeleid. Dit beleid is vóór het afrekenen zichtbaar in de winkelwagen.
  • Pricebeat kan je op verzoek helpen de verkopende partij te bereiken en kan terugbetalingen verwerken wanneer die partij daartoe opdracht geeft, maar is niet zelf verantwoordelijk voor de retourbehandeling.

Externe aanbieding (§5c)

  • De koop komt tot stand met de externe webshop. Herroeping en retour lopen volledig via de algemene voorwaarden en het retourbeleid van die webshop.
  • Pricebeat speelt geen rol bij retouren, herroeping of terugbetaling van externe aanbiedingen.

Algemene punten, voor zover wettelijk van toepassing:

  • Het product moet ongebruikt en in de originele staat zijn.
  • Het herroepingsrecht geldt niet voor producten die snel bederven, op maat gemaakt zijn, of om andere redenen wettelijk zijn uitgezonderd.
  • Wie de retourkosten betaalt, wordt vóór het afrekenen vermeld.

7. Beperkingen van aansprakelijkheid

Onze aansprakelijkheid volgt onze rol in de transactie. Behalve bij opzet of grove schuld aan onze kant is Pricebeat niet aansprakelijk voor schade buiten de hieronder beschreven kaders. Deze beperkingen doen geen afbreuk aan je wettelijke rechten als consument.

Pricebeat-aanbieding, Pricebeat als verkoper (§5a)

Pricebeat is aansprakelijk zoals elke verkoper onder het Nederlandse consumentenrecht: voor levering, conformiteit, garantie en retourafhandeling binnen de geldende wettelijke kaders.

Pricebeat-aanbieding, externe partij als verkoper (§5b)

De externe verkoper is aansprakelijk voor alles wat met het product en de levering te maken heeft: kwaliteit, verzendtijd, garantie, retourbehandeling, klantenservice en non-conformiteit. Pricebeat is aansprakelijk voor de platformdienst zelf, zoals het correct verwerken van de betaling en het doorgeven van je bestelling aan de verkopende partij.

Externe aanbieding (§5c)

Pricebeat is geen partij bij de transactie en aanvaardt geen aansprakelijkheid voor aankopen via een externe aanbieding. Dit omvat, zonder beperking, afwijkingen tussen de prijs of voorraad die wij tonen en de daadwerkelijke prijs of voorraad bij de externe webshop op het moment van doorklikken, kwaliteitsproblemen, vertragingen, garantieclaims, retouren en klantenservice.

8. Intellectueel eigendom

Alle rechten op het Pricebeat-merk, logo, de website, de mobiele app, de Chrome-extensie, teksten, afbeeldingen, code en andere inhoud zijn van Pricebeat BV of onze licentiegevers. Je mag onze Diensten gebruiken voor je persoonlijke, niet-commerciele doeleinden. Wat niet mag:

  • Onze website, app of extensie scrapen, reverse-engineeren of kopieren.
  • Ons merk of logo gebruiken zonder schriftelijke toestemming.
  • Onze Diensten gebruiken om geautomatiseerd prijsinformatie te verzamelen en door te verkopen.
  • Inhoud van Pricebeat hergebruiken voor een concurrerende dienst.

Plaats je zelf inhoud op Pricebeat (bijvoorbeeld een review of een bericht aan support)? Dan geef je Pricebeat een kosteloze, wereldwijde licentie om die inhoud te gebruiken voor het leveren en verbeteren van onze Diensten.

9. Wijzigingen van de Diensten

Pricebeat mag op elk moment functies toevoegen, wijzigen of verwijderen, en de Diensten aanpassen of stopzetten. Dit kan bijvoorbeeld in verband met operationele wijzigingen, wettelijke eisen of andere zakelijke overwegingen. Bij ingrijpende wijzigingen proberen we je vooraf te informeren.

10. Beeindiging

Je kunt je account op elk moment sluiten door een verzoek te sturen naar [email protected]. We verwijderen dan je account en bijbehorende gegevens, behalve gegevens die we wettelijk moeten bewaren (bijvoorbeeld fiscale administratie).

Pricebeat kan jouw toegang tot de Diensten opschorten of beeindigen als je deze Voorwaarden of de wet schendt, of als je gedrag schadelijk is voor andere gebruikers, verkopers of Pricebeat.

11. Geschillen

Ontstaat er een geschil tussen jou en een verkoper? Probeer dat eerst samen op te lossen. Komen jullie er niet uit, dan bemiddelt Pricebeat waar mogelijk. Komen jullie er dan nog niet uit, dan kun je de zaak aan de rechter voorleggen.

Als consument kun je een geschil ook melden via het Europees platform voor onlinegeschillenbeslechting (ODR): https://ec.europa.eu/consumers/odr.

12. Toepasselijk recht en taal

Op deze Voorwaarden is Nederlands recht van toepassing. Geschillen worden exclusief voorgelegd aan de bevoegde rechter in Nederland.

Deze Voorwaarden zijn beschikbaar in het Nederlands en het Engels. Bij verschillen tussen de twee versies is de Nederlandse versie leidend.

13. Splitsbaarheid

Als een bepaling uit deze Voorwaarden nietig of onverbindend blijkt, blijven de overige bepalingen onverkort gelden. We vervangen de ongeldige bepaling dan door een bepaling die zo dicht mogelijk bij de oorspronkelijke bedoeling aansluit.

14. Wijzigingen van deze Voorwaarden

We kunnen deze Voorwaarden van tijd tot tijd aanpassen. Bij ingrijpende wijzigingen laten we je dat weten via e-mail of een melding in de app. De datum bovenaan deze pagina geeft aan wanneer de versie voor het laatst is bijgewerkt. Blijf je Pricebeat gebruiken na een wijziging, dan accepteer je de nieuwe versie.

At Pricebeat we believe in transparency, honesty and respect for your privacy. To put your mind at ease: we are not a shady company. Quite the opposite. We think finding lower prices online should be easier because life is expensive enough already. We don't spy on you and we don't sell your personal data to third parties.

What we do with your data is exactly what you would expect. When you ask us to recognise a product, we look at your screen to see what you are viewing. If recognition succeeds, we see whether we can show you a better price. Sometimes Pricebeat sells directly (you'll see "Sold by Pricebeat.nl"), sometimes a connected partner does (you'll see "Sold by [partner name]"), and sometimes we point you to another webshop that is cheaper. If you place an order on Pricebeat, we share your address with the selling party so they can deliver the product. We don't collect more than we need, we don't share more than we need, and we don't do anything weird.

  • Services: the Pricebeat website, mobile app and Chrome extension, together with all their functionality.
  • User / you: anyone using our Services.
  • Pricebeat offer: an offer you can purchase through Pricebeat's own checkout. The selling party is always clearly shown before checkout and can be Pricebeat itself ("Sold by Pricebeat.nl") or a connected external partner ("Sold by [partner name]").
  • Selling party: the party identified as the seller for a Pricebeat offer and the contractual counterparty to the purchase. All consumer rights (withdrawal, warranty, non-conformity) run against this party.
  • External offer: a price known to us that we display on Pricebeat, with a link to the webshop where the offer is listed. The entire purchase takes place on that webshop; Pricebeat is not a party to that transaction. The link may be an ordinary link or an affiliate link, which does not change your price or our role.
  • Buyer: a user who purchases a product through a Pricebeat offer.

3. These Terms

These Terms and Conditions apply to every use of our Services. By using Pricebeat you agree to these Terms. If you do not use Pricebeat, they do not apply to you.

4. Your account

To use some features you need to create an account. For your account the following applies:

  • You provide accurate and up-to-date information (name, email, delivery address).
  • You keep your login details confidential and do not share them with others.
  • Activity originating from your account is your responsibility.
  • If you notice someone else is using your account, report it immediately to [email protected].
  • You must be at least 16 years old to create an account.

5. How Pricebeat works

Pricebeat connects supply and demand in three ways. Our role and responsibility change with each. Which one applies is always clearly shown on the product screen and in the shopping cart before checkout.

5a. Pricebeat offer, Pricebeat as selling party

If the shopping cart shows "Sold by Pricebeat.nl", Pricebeat BV is the seller. In practice:

  • The sales contract is between you and Pricebeat.
  • Pricebeat processes payment and arranges shipping, directly or through a contracted supplier.
  • Pricebeat is responsible for delivery, warranty, right of withdrawal, returns, non-conformity and customer service for this order.

5b. Pricebeat offer, external party as selling party

If the shopping cart shows a different seller ("Sold by [partner name]"), that external party is the seller and Pricebeat acts as the platform. In practice:

  • The sales contract is formed between you and the listed external seller, not with Pricebeat.
  • Pricebeat processes payment on behalf of the selling party and forwards your order details so they can deliver.
  • The external seller is responsible for delivery, quality, warranty, right of withdrawal, returns, non-conformity and customer service.
  • Pricebeat mediates where possible if a dispute arises and may process refunds when instructed or required by the selling party.

5c. External offer (link to another webshop)

If the offer appears as a button to another webshop (for example "View at [webshop name]") instead of an "Add to cart" button, it is an external offer. You leave Pricebeat and purchase directly from that webshop. In practice:

  • Pricebeat is NOT a party to the transaction. The sales contract is formed exclusively between you and the external webshop.
  • That webshop's terms and conditions apply to the purchase, delivery, payment, warranty, returns and customer service.
  • The price, availability and product details we show for an external offer may already have been changed by the external webshop by the time you click through. We cannot guarantee that this information is still current.
  • The link to the external webshop may be an ordinary link or an affiliate link for which Pricebeat receives a fee if you make a purchase. This does not change the price you pay.
  • Pricebeat has no role in delivery, payment, warranty, returns or customer service for an external webshop. For those matters, contact the webshop directly.

What you as a buyer do

  • You provide accurate payment and delivery details.
  • You read the return and warranty policy of the selling party (or, for an external offer, of the external webshop) before ordering.
  • You use the product as reasonably intended.

We try to keep the information on the platform as accurate as possible, but we cannot guarantee that every product detail or price is 100% correct at every moment.

6. Returns and Right of Withdrawal

As a consumer you have the right to cancel the purchase within 14 days of receipt, without giving a reason. This is governed by Book 7, Title 7AA of the Dutch Civil Code (the Dutch implementation of EU Consumer Rights Directive 2011/83/EU). The right of withdrawal always runs against the selling party, so the procedure depends on the type of offer.

Pricebeat offer, Pricebeat as seller (§5a)

  • Notify Pricebeat of the cancellation within 14 days of receipt via [email protected].
  • Return the product within a further 14 days to the address we provide.
  • After receipt and inspection you receive your refund from Pricebeat within 14 days.

Pricebeat offer, external party as seller (§5b)

  • Notify the selling party of the cancellation in line with their return policy. That policy is visible in the shopping cart before checkout.
  • Pricebeat can help you reach the selling party on request and may process refunds when instructed by that party, but is not itself responsible for returns handling.

External offer (§5c)

  • The sales contract is formed with the external webshop. Withdrawal and returns are handled entirely under that webshop's terms and conditions and return policy.
  • Pricebeat plays no role in returns, withdrawal or refunds for external offers.

General points, to the extent legally applicable:

  • The product must be unused and in its original condition.
  • The right of withdrawal does not apply to products that are perishable, made to order, or otherwise excluded by law.
  • Who pays the return costs is stated before checkout.

7. Limitations of liability

Our liability follows our role in the transaction. Except in the case of wilful misconduct or gross negligence on our part, Pricebeat is not liable for damage beyond the scope described below. These limitations do not affect your statutory rights as a consumer.

Pricebeat offer, Pricebeat as seller (§5a)

Pricebeat is liable as any seller is under Dutch consumer law: for delivery, conformity, warranty and returns handling within the applicable legal framework.

Pricebeat offer, external party as seller (§5b)

The external seller is liable for everything relating to the product and its delivery: quality, shipping time, warranty, returns handling, customer service and non-conformity. Pricebeat is liable for the platform service itself, such as correctly processing payment and forwarding your order details to the selling party.

External offer (§5c)

Pricebeat is not a party to the transaction and accepts no liability for purchases made via an external offer. This includes, without limitation, differences between the price or stock we display and the actual price or stock at the external webshop at the moment you click through, quality issues, delays, warranty claims, returns and customer service.

8. Intellectual property

All rights to the Pricebeat brand, logo, website, mobile app, Chrome extension, texts, images, code and other content belong to Pricebeat BV or our licensors. You may use our Services for your personal, non-commercial purposes. You may not:

  • Scrape, reverse-engineer or copy our website, app or extension.
  • Use our brand or logo without written permission.
  • Use our Services to collect pricing information for automated resale.
  • Repurpose Pricebeat content for a competing service.

If you post content on Pricebeat (for example a review or a message to support), you grant Pricebeat a royalty-free, worldwide licence to use that content to provide and improve our Services.

9. Changes to the Services

Pricebeat may add, change or remove features at any time, and may adjust or discontinue the Services. This may happen due to operational changes, legal requirements or other business considerations. For material changes we will try to notify you in advance.

10. Termination

You may close your account at any time by sending a request to [email protected]. We will then delete your account and associated data, except data we are legally required to retain (for example tax records).

Pricebeat may suspend or terminate your access to the Services if you breach these Terms or the law, or if your behaviour is harmful to other users, sellers or Pricebeat.

11. Disputes

If a dispute arises between you and a seller, first try to resolve it together. If that does not work, Pricebeat will mediate where possible. If that still does not lead to a solution, you may take the matter to court.

As a consumer you may also submit a dispute via the European Online Dispute Resolution platform (ODR): https://ec.europa.eu/consumers/odr.

12. Governing law and language

These Terms are governed by Dutch law. Disputes will be submitted exclusively to the competent court in the Netherlands.

These Terms are available in Dutch and English. In case of any discrepancy between the two versions, the Dutch version prevails.

13. Severability

If any provision of these Terms is found to be void or unenforceable, the remaining provisions remain in full force. Any invalid provision will be replaced by one that comes as close as possible to the original intent.

14. Changes to these Terms

We may update these Terms from time to time. For material changes we will notify you by email or via an in-app notification. The date at the top of this page indicates when the version was last updated. If you continue to use Pricebeat after a change, you accept the new version.
